How overtime works

If you are a non-exempt hourly worker, the federal Fair Labor Standards Act says you earn time and a half, 1.5 times your regular rate, for every hour over 40 in a single workweek. Hours up to 40 are paid at your normal rate.

Say you make $18 an hour and work 46 hours. The first 40 hours pay $720. The extra 6 hours pay at $27 an hour (1.5 x $18), which is $162. Your gross for the week is $882 before taxes. Texas and Louisiana both follow the federal 40-hour rule, so there is no separate daily overtime in those states.

This is gross pay. To estimate what actually reaches your bank account after taxes, use the paycheck (take-home) calculator.

Overtime FAQ

Common questions

How is overtime pay calculated?
Under the federal Fair Labor Standards Act (FLSA), most hourly workers earn overtime at 1.5 times their regular rate for every hour worked over 40 in a workweek. For example, at $18 an hour your overtime rate is $27 an hour. Hours up to 40 are paid at your regular rate.
When does overtime start?
Federally, overtime starts after 40 hours in a single workweek. Texas and Louisiana follow the federal rule, so there is no daily overtime requirement in those states. A few other states (such as California) add daily overtime rules.
What is time and a half?
Time and a half means 1.5 times your regular hourly rate. If you earn $16 an hour, time and a half is $24 an hour. It is the standard overtime rate for hours over 40 in a week.
Is overtime taxed differently?
No. Overtime pay is taxed the same way as your regular wages. It can look like more was withheld on a big check because the higher gross can bump that paycheck into a higher withholding tier, but the tax rate on overtime itself is not special. See our paycheck calculator for a take-home estimate.
